Terms and Conditions
This Agreement outlines the policies, procedures, rules, and restrictions associated with opening, joining, and maintaining Daffodil Charitable ("Daffodil") donor-advised fund ("DAF") accounts. Participation in Daffodil Charitable's activities is subject to these terms and conditions. In engaging with Daffodil Charitable and Daffodil donor-advised fund accounts, members agree to accept and be bound by this Agreement. Daffodil reserves the right to modify or change this Agreement at any time for any reason.
In the event of modifications or changes, Daffodil will update the Agreement on its website. Members are responsible for periodically reviewing this Agreement to be informed of updates.
About Daffodil Charitable
Daffodil Charitable ("Daffodil") is a tax-exempt public charity as described in Sections 501(c)(3), 509(a)(1), and 170(b)(1)(A)(vi) of the Internal Revenue Code, EIN 331630163. Daffodil is eligible to receive charitable contributions under IRC Section 170(c). As per IRS requirements, all contributions are irrevocable, and Daffodil Charitable retains exclusive legal control over all assets held in a Daffodil Charitable fund.
Daffodil Charitable does not provide legal or tax advice and recommends that all members consult a tax professional before claiming any income tax deduction.
Mission and Vision
Daffodil Charitable is a charitable nonprofit with a simple mission: to amplify charitable impact. We do this by intelligently connecting donors with proven, effective nonprofit organizations in the United States and streamlining philanthropy by making giving a habit.
Donor-Advised Funds: Daffodil, as a tax-exempt public charity, serves as a sponsoring organization overseeing and administering donor-advised funds ("DAFs").
When a donor creates a Daffodil Charitable DAF, a fund is created where they may provide recommendations on managing their charitable giving. Members may contribute to their fund at any time. Contributions are unconditional and irrevocable charitable donations to Daffodil Charitable, a recognized 501(c)(3) public charity. Members generally may take an immediate tax deduction for the calendar year in which the contribution is made.
Members serve as an advisor over their fund, recommending how the fund is invested and distributed. However, Daffodil Charitable retains ultimate authority and control over the assets in the fund.
Members may recommend that their fund be invested in investment options that are made available to members. Changes in the value of an investment portfolio are attributed to the fund, and members can submit donation recommendations to an eligible charity up to the full available balance of the fund at any time.
When a member is ready to support a charitable organization, they may recommend a donation to any public charity, subject to the donation restrictions detailed in this agreement. Once approved by Daffodil Charitable at its sole discretion, the donation amount is deducted from the fund and sent directly to the charity. Donations may be attributed to the donor or made anonymously.
Donors can sign up for an account online or via a financial advisor. To create an account, a donor must provide authentication credentials and necessary personal and financial information. If the member is creating a new fund, a linked bank account, debit card, or credit card may be required. Additional information may be required for transaction authorization.
By opening a Daffodil Charitable donor-advised fund, donors certify that they will provide accurate and complete personal identifying information and notify Daffodil Charitable of any changes. Daffodil Charitable reserves the right to verify the provided information.
Eligibility
Any individual 18 years or older, corporation, or trust may become a Daffodil Charitable participant, create a fund, or join an existing fund. Those residing outside the U.S. may not be eligible for an income tax deduction for contributions. Daffodil Charitable is not responsible for reviewing the authority of designees for any corporation or trust.
Account Access
Daffodil Charitable account holders may access their accounts at any time through the Daffodil platform by logging in with their email address and password. Additional security options like two-factor authentication ("2FA") may be supported. Members are responsible for securing their accounts. Daffodil Charitable is not responsible for any losses resulting from unauthorized activity.
Contributions
When an account holder adds cash or assets to their fund, they are making an irrevocable contribution to Daffodil Charitable. Depending on their tax situation, members may be eligible to take an income tax deduction for the contribution. Contributed assets are no longer a part of the individual member's personal estate, and Daffodil Charitable retains exclusive legal control over all fund balances.

- Publicly Traded Securities
- Transfers from other Donor-Advised Funds

Investment Options
Daffodil Charitable offers several approved investment portfolios. These portfolios offer potential tax-free growth, increasing funds available for charitable distribution. Daffodil reserves the right to modify available investment portfolios at any time.

Donation Recommendations and Activity
Donation recommendations may be submitted at any time. Daffodil Charitable attempts to fulfill all recommendations that meet its guidelines; however, donation recommendations are advisory. Daffodil Charitable retains ultimate authority and reserves the right to deny any donation recommendation. Daffodil Charitable requires at least one grant recommendation every year to fulfill minimum activity requirements: if no grants are distributed for one year, Daffodil Charitable will attempt to contact the account holder to initiate a distribution. If no grant activity is present for 18 months, Daffodil Charitable will distribute 5% to the Daffodil Charitable Discovery Fund.

Regulatory and Governance
Daffodil Charitable is governed by its Board of Directors, which maintains oversight of all fund activities, regulatory compliance, and investment decisions.
Daffodil Technologies provides Daffodil Charitable with technical and operational services. Daffodil Charitable account holder information is shared with Daffodil Technologies, which owns and operates the intellectual property Daffodil Technologies utilizes in connection with its platform(s). Daffodil Charitable compensates Daffodil Technologies fair market value for its platform license and services.
Governing Law
This Agreement shall be governed by the laws of the State of Colorado.

Daffodil Charitable maintains a transparent fee structure to cover operational costs and ensure sustainable service. These fees help us maintain our platform, process grants to charitable organizations, and provide quality service to our members.
Our granting policies are designed to ensure timely and efficient disbursement of funds to eligible charitable organizations while maintaining compliance with all applicable regulations.
